12. Product Safety, Child Safety & Assumption of Risk
12.1 General Product Disclaimer
ALL PRODUCTS SOLD BY THOSON.COM ARE PROVIDED "AS IS" AND "AS AVAILABLE." THOSON.COM makes no warranties, express or implied, regarding the fitness of any product for a particular purpose, merchantability, or safety beyond the product description provided on the website. By purchasing any product from THOSON.COM, you acknowledge and accept full responsibility for the proper and safe use of said product.
12.2 Adult Supervision & Parental/Guardian Responsibility
THOSON.COM PRODUCTS ARE INTENDED FOR USE BY ADULTS OR UNDER DIRECT, CONTINUOUS ADULT SUPERVISION. Unless explicitly stated otherwise on the specific product listing, our products are NOT designed, tested, or certified as children's toys and may contain small parts, sharp edges, electronic components, magnets, batteries, or other features that could pose a choking hazard, injury risk, or other danger to children.
By purchasing any product from THOSON.COM, the purchaser (whether a parent, legal guardian, or any other person) expressly acknowledges and agrees to the following:
(a) Supervision Required. Children under the age of 18 (or the age of majority in the buyer's jurisdiction, whichever is higher) must be directly and continuously supervised by a responsible adult at all times while using, handling, or in the proximity of any THOSON.COM product. The purchaser assumes full and sole responsibility for ensuring adequate supervision.
(b) Risk Assessment. It is the sole responsibility of the purchaser and/or supervising adult to assess whether a product is appropriate for a child based on the child's age, maturity, physical abilities, and any known medical conditions, allergies, or sensitivities. THOSON.COM does not and cannot assess the suitability of any product for any individual child.
(c) Misuse & Unintended Use. THOSON.COM shall not be held liable for any injury, damage, illness, allergic reaction, or death resulting from the misuse, improper use, unintended use, modification, alteration, or negligent use of any product, including but not limited to use by children without appropriate adult supervision.
(d) No Classification as Toys. Unless a product is explicitly labeled and marketed as a "toy" or "child-safe" on its specific product page, no THOSON.COM product should be considered safe for unsupervised use by children. Even products that may appear suitable for children (due to color, design, shape, or theme) are NOT certified children's toys unless expressly stated.
(e) Choking & Ingestion Hazards. Many products may contain small parts, detachable components, magnets, batteries, or materials that pose serious choking, ingestion, or suffocation hazards to young children. The purchaser is solely responsible for keeping such products out of the reach of young children.
(f) Compliance with Local Safety Standards. Product safety standards vary by country and jurisdiction (including but not limited to the U.S. Consumer Product Safety Commission (CPSC), EU Toy Safety Directive 2009/48/EC, UK Toy Safety Regulations, and equivalent regulations in other jurisdictions). The purchaser is solely responsible for determining whether any product complies with the safety regulations applicable in their jurisdiction before allowing use by minors.
12.3 Assumption of Risk
BY PURCHASING AND/OR USING ANY PRODUCT FROM THOSON.COM, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH THE USE, HANDLING, STORAGE, AND DISPOSAL OF SUCH PRODUCT. This includes, without limitation, risks of personal injury, property damage, allergic reactions, skin irritation, electrical hazards, burns, choking, ingestion of parts, or any other harm that may arise from the use or misuse of the product, whether foreseeable or unforeseeable.
You acknowledge that THOSON.COM has no control over how products are used after delivery and cannot be held responsible for consequences arising from improper storage, handling, modification, or use in conditions or environments for which the product was not intended.
12.4 Waiver of Claims Related to Minors
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the purchaser, parent, legal guardian, or any person who provides a THOSON.COM product to a minor hereby waives, releases, and forever discharges THOSON.COM, its owners, directors, officers, employees, agents, affiliates, suppliers, and partners from any and all claims, demands, actions, causes of action, lawsuits, damages (including but not limited to compensatory, punitive, incidental, special, and consequential damages), costs, expenses, and liabilities of any kind or nature arising from or related to:
- Any injury, illness, allergic reaction, or death of a minor resulting from the use, handling, or proximity to any THOSON.COM product;
- Any damage to property caused by a minor's use or handling of any THOSON.COM product;
- Any misuse, improper use, or unintended use of any THOSON.COM product by a minor;
- Failure of the purchaser, parent, or guardian to provide adequate supervision;
- Failure of the purchaser to assess the suitability of the product for a particular child.
Note: Some jurisdictions do not allow the exclusion or limitation of liability for personal injury or death caused by negligence. In such jurisdictions, the above waiver shall apply only to the extent permitted by law. This waiver does not purport to exclude liability that cannot be excluded under mandatory consumer protection laws applicable in the buyer's jurisdiction.
12.5 Product Warnings & Instructions
Where applicable, THOSON.COM provides product descriptions, usage guidelines, and safety warnings on product pages. The purchaser is responsible for reading and following all provided instructions and warnings before using or allowing others to use the product. Failure to follow product instructions or warnings releases THOSON.COM from any liability for resulting harm.
12.6 Allergies, Sensitivities & Health Conditions
Products sold by THOSON.COM may contain materials, chemicals, dyes, adhesives, metals, or other substances that could cause allergic reactions, skin irritation, or adverse health effects in certain individuals. It is the sole responsibility of the purchaser to review all product materials and descriptions before purchase and use, and to consult with a medical professional if there is any doubt about potential reactions. THOSON.COM shall not be held liable for any allergic reaction, skin irritation, respiratory issue, or other adverse health effect caused by any product.
13. Disclaimer of Warranties & Limitation of Liability
THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, THOSON.COM, its owners, directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for personal injury, death, loss of profits, data, or goodwill, arising from:
- The use or inability to use our products or services;
- Any product defect, whether known or unknown at the time of sale;
- Misuse, improper use, modification, or negligent use of any product;
- Use of products by minors without adequate adult supervision;
- Allergic reactions, health complications, or injuries caused by product materials;
- Non-compliance with local safety regulations by the buyer.
In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities (such as the European Union, United Kingdom, Australia, or other consumer-protection jurisdictions), the limitations above shall apply only to the fullest extent permitted by applicable mandatory law. Nothing in these Terms shall affect your statutory rights as a consumer under applicable law.
Maximum aggregate liability: In any event, THOSON.COM's total aggregate liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific product(s) giving rise to the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless THOSON.COM, its owners, directors, officers, employees, agents, affiliates, suppliers, and partners from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable attorney's fees) arising from or related to: (a) your breach of these Terms; (b) your misuse of any product or service; (c) your failure to supervise a minor's use of any product; (d) your failure to comply with applicable laws and safety regulations; or (e) any third-party claim arising from your use of THOSON.COM products.
15. Severability
If any provision of these Terms is deemed unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
16. Termination
These Terms remain effective unless terminated by you or us. We may suspend or terminate access if these Terms are violated.
17. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom, except where mandatory consumer protection laws of the buyer's jurisdiction provide otherwise.
For EU/EEA consumers: Nothing in these Terms affects your right to bring proceedings in the courts of your Member State of domicile, in accordance with Regulation (EU) No 1215/2012.
